
Follow Up of the Day: YouTube said on Friday that Universal Music Group was in the wrong when it took down a video of various celebrities (including some Universal artists) endorsing file-sharing service Megaupload.
“Our partners do not have the right to take down videos from YT unless they own the rights to them or they are live performances controlled through exclusive agreements with their artists, which is why we reinstated it,” YouTube said in a statement.
Although Universal has direct access to YouTube’s content management system thanks to a deal with Google, YouTube’s statement suggests that taking down the Megaupload video — which contains no copyrighted UMG material — is beyond the scope of that agreement.
The video has since been reinstated.
Meanwhile, Megaupload is seeking monetary damages from Universal, and Universal is arguing that it shouldn’t have to pay because killing a video via YouTube’s private video management system doesn’t count as an official DMCA takedown notice.
