Controversial Copyright Ruling of the Day

Controversial Copyright Ruling of the Day: An English court has ruled that the composition of a photograph can be protected by copyright law, exposing photographers who take similar photos to potential lawsuits.

In the case, a UK souvenir company called Temple Island sued New English Teas for using a photo of a London bus on its packaging.

Temple Island claimed it was “the creator of the Red Bus image and originator of the product concept,” even though New English Teas’ red bus photo was taken from a different vantage point and at a different angle.

Going against years of legal precedent that say no one can copyright an idea, the judge ruled in favor of Temple Island because he found “a substantial part” of their work had been reproduced.

Photo copyright experts say the Temple Island case is likely to bring on similar claims in UK courts.

New English Teas has not yet announced whether it intends to appeal the decision.
